If you Googled “Portugal D8” the week Law 62/2026 landed and one tab said the country had slammed immigration shut, that tab was describing tourist-to-residence workarounds — not the digital-nomad visa. The D8 file is still a consular application. The number on it moved with the wage decree: 2026 RMMG is €920 a month, and the remote-work rule is four times that, so the main-applicant floor is €3,680 a month averaged over the last three months. This is the September 2026 file note: income math, Law 62/2026, employee versus freelancer, consulate then AIMA. It is a sourced summary, not legal advice and not a permit in your passport.
The pain: a September headline, not a cancelled visa
Nomad chats still paste two screenshots that do not belong in the same folder:
- “Portugal just closed digital-nomad visas.” It did not. Lei n.º 62/2026 (Diário da República n.º 176/2026, 10 September; in force 11 September) amends the foreigners law, asylum rules, and EU migration-pact instruments. The clause people are actually pointing at is the tighter article 92 student path: secondary / CITE level-4 students now need a residence visa issued under article 62 before a residence permit is granted. Combined with the 2024 end of manifestações de interesse, that is another nail in “fly in as a tourist and convert later.” It is not a repeal of article 61.º-B.
- “The D8 floor is still last year’s €3,480.” It is not. Decreto-Lei n.º 139/2025 (29 December 2025) sets the 2026 retribuição mínima mensal garantida at €920 from 1 January. The remote-work documentary rule is four RMMG. 4 × 920 = €3,680.
Pack the income PDF against the page that will actually open your file. The folders are the same either way. The monthly number is not last year’s.
Income math (September 2026)
Read this as one multiplier on a published wage, not as a blog’s round number. Confirm the live consulate or AIMA checklist before you book.

The 4× rule is a documentary average, not a licence to show one fat invoice and two empty months. Arts. 18.º-B and 31.º-A both say rendimentos médios mensais… nos últimos três meses of a minimum equal to four guaranteed monthly minimum wages. Label the PDF so a case worker does not have to reverse-engineer your payroll app.
What Law 62/2026 actually did (and did not do)
The gazette text is a long EU-pact + foreigners-law amendment, not a D8 repeal. Practitioner notes — including Al Kabban on D7/D8 and GrowIN Portugal on the 11 September in-force date — are aligned on the procedural punch: Portugal is closing more in-country regularisation and tourist-to-residence shortcuts. The ordinary consular residence-visa pathway is the thing the law is pushing people toward, not away from.
- Closed / tightened: article 92 now ties a secondary / level-4 student residence permit to a prior residence visa. That is the workaround that had replaced, for some nationalities, the old “arrive, enrol, convert” story after manifestações de interesse died in 2024. Law 62/2026 also tightens irregular-stay, return, and asylum-procedure machinery. Treat those pages as practitioner summaries of the gazette, not as a substitute for a lawyer on your facts.
- Still open: the D8 remote-work visa (temporary stay or residence) and the later AIMA residence card for holders of that visa. AIMA’s digital-nomad residence page is still the in-country step after a valid remote-work residence visa. Existing lawful visas and cards are not cancelled by the September headline.
If your plan was “land in Lisbon on 90/180 and file D8 from a café,” that was already the wrong decade. Law 62/2026 makes the leftover tourist-to-status stories even worse. It does not make the consular D8 disappear.
Snapshot: consular visa versus AIMA residence
Portugal split the product the same way most national-visa systems do. The English-friendly hubs are the MNE national-visa types page, the MNE residence document list (specific heading: remote work / nómada digital), and AIMA’s Art. 88.º n.º 1 “Nómadas Digitais” page.

AIMA’s legal frame for the card is article 88.º, n.º 1 of the foreigners law (REPSAE) plus the regulatory articles it lists. The visa you used to enter has to match: a valid visto de residência for remote work performed outside Portugal. A Schengen C or a tourist stamp is not that visa.
Portugal checklist: income, employee vs freelancer, insurance, housing, where to apply
Primary hubs: MNE — Residência, the Buenos Aires nómada digital note as a worked consular example, and AIMA — Nómadas Digitais. Documents in Portuguese (or with a certified translation). Foreign public documents: Hague Apostille or consular legalisation. We are not reprinting a fee menu — MNE, VFS, and AIMA publish their own, and they move.
Income pack (the 3-month / 4× pattern)
- Lead applicant: show average monthly remote-work income of at least €3,680 over the last three months (4 × €920). That sentence is the regulatory decree plus the 2026 wage decree, not a blog’s round-up.
- Proof: bank statements and/or payslips that a stranger can map onto the contract. Currency must be obvious. Do not average a signing bonus into a quiet quarter and hope.
- Family: the MNE general means-of-support page still uses the Portaria-style 100% / 50% / 30% of RMMG per-capita table (€920 / €460 / €276 on the 2026 wage). That is a different calculator than “add 50% of €3,680.” Ask the consulate which stack they want before you invent a household total.
Employee versus freelancer (foreign-source only)
Article 61.º-B is the same sentence for both: remote activity for a natural or legal person with domicile or seat outside Portuguese territory, and you have to demonstrate the employment link or the services. The decree then splits the PDF:
- Subordinado (employee): employment contract, or (temporary-stay path) a promise of contract, or an employer declaration proving the link. The money has to be foreign-source remote work — this is not a permit to take a Portuguese employer.
- Independente (freelancer / own company): company contract, services contract, (temporary-stay path also allows a written proposal), or a document showing services already provided to one or more entities. Same 4× / three-month floor. Same “clients sit outside Portugal” logic.
- Both: a document that attests your fiscal residence. Pack it. It is in the same lettered list as the income PDF.
Insurance
MNE’s general residence list wants travel cover that will actually pay medical costs, including urgent care and repatriation, for the visa period. Buenos Aires’ digital-nomad note says health insurance may be valid for 120 days on a residence visa (and for the intended period on a temporary-stay visa). That is that mission’s published line, not a nationwide euro-amount we found on AIMA. Use the checklist your consulate publishes this month. A home-country policy that silently excludes “residing abroad” is a refusal waiting to happen.
Housing / address
Buenos Aires wants accommodation proof for a minimum of one year on a residence visa, or for the intended period on temporary stay. AIMA’s card stage wants a sworn address declaration (owner, tenant, subtenant, usufruct, loan-for-use, etc.) plus either a land-registry certificate / access code or a landlord / hosting-entity declaration. Have a stay you can document. Do not fly in, dump a suitcase in an Airbnb that forbids registration, and assume Loja AIMA will wait.
Where to apply
- Outside Portugal: the Portuguese consulate / mission (or VFS) for your legal residence. Pick temporary stay if you genuinely want less than a year; pick the residence visa if you want the two-year AIMA card. MNE: the residence visa is the four-month, two-entry ticket to the AIMA file, not the card itself.
- Not now: arriving visa-free or on a Schengen C and treating the 90 days as “D8 processing time.” That is the shortcut Law 62/2026 is part of closing. Older 2023–2024 posts that still describe in-country regularisation are describing a previous regime.
- After you enter on the residence visa: book AIMA (or use the electronic channel if your post already printed the link on the vignette). Bring the valid remote-work residence visa, passport, foreign employer / client sworn declaration, and the address pack AIMA lists. The first card is two years if granted. That is a second file, not an automatic sticker.
A light contrast with Spain (and the rest of the 2026 file)
Spain’s 2026 telework visa is a different multiplier on a different wage: Plataforma ONE says 200% of SMI. Consulate-style math is €2,442 / mo (200% × €1,221); blogs that annualise 14 pays land near €2,849. That debate lives on the Spain digital-nomad visa income note. Portugal’s D8 number is simpler arithmetic — 4 × €920 — and a higher floor. Spain still describes an in-country UGE door for people already in a regular situation. Portugal’s September story is the opposite mood: more doors that started as tourist entry are shut; start at the consulate.

This week’s file (do this, then book)
- Pick the door. Temporary stay (< 1 year) or residence visa → AIMA two-year card. Do not treat a tourist stamp as a Portugal version of “I’ll convert later.”
- Income pack in one folder: three months that average at least €3,680, plus the employee letter or the freelancer contract set, plus fiscal residence. Family add-ons calculated the way that consulate writes them.
- Insurance certificate that names the territory and the dates. Screenshot the exclusion page.
- Housing artefact: a stay you can later put on AIMA’s address declaration, not a “friends couch.”
- Where-to-apply booking: Portuguese mission / VFS before the flight. Put the appointment in the calendar first; the cheap fare second.
- Criminal record / passport validity / translations on the consular side; employer/client sworn declaration + address pack on the AIMA side. These are the documents people leave until the appointment email lands.

A four-month residence visa or a two-year AIMA card does not include a working mobile pipe.
